MyGlowApp Terms and Conditions of Use

1. Service Ownership
In compliance with Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), we inform you that the mobile application MyGlowApp (hereinafter, the "Application") is owned by:

2. Purpose and Service Description
MyGlowApp is a subscription-based digital tool that uses artificial intelligence to offer personalized cosmetic recommendations. The service includes:
- Facial Analysis: Use of AI to detect aesthetic characteristics of the skin from a photograph.
- Personalized Routine: Recommendation of facial care routines (skincare) and dermocosmetic products based on the analysis.
- Product Scanner: Tool to verify the compatibility of cosmetic products with the user's profile.
- Progress Tracking: Weekly Check-in functionality to monitor the visual evolution of the skin through image comparison.

MYGLOWAPP IS NOT A MEDICAL APPLICATION OR A DIAGNOSTIC DEVICE. The information, skin analysis, and recommendations provided are for exclusively aesthetic, informational, and educational purposes.
- We are not doctors: The service does not replace the advice, diagnosis, or treatment of a dermatologist or healthcare professional.
- We do not diagnose: The AI identifies visible characteristics (such as redness, texture, or luminosity) for cosmetic purposes, not pathological ones.
- Consult a specialist: If you have or suspect you have a medical skin condition (infection, severe acne, wounds, suspicious moles, etc.), you should see a doctor before using any recommended product.
3. Access Requirements and Age
Access, registration, and use of MyGlowApp is strictly reserved for persons 18 years of age or older. By creating an account, you declare under your sole responsibility that you are of legal age. COSITY TECH S.L. reserves the right to request documentation to verify age and delete any account if it detects that it belongs to a minor. Use of the application by persons under 18 years of age is prohibited.
4. Subscriptions, Payments, and Renewal
MyGlowApp operates under a paid subscription model managed through third-party platforms Apple App Store and Google Play Store ("App Stores").
- Payment: The subscription amount will be charged to your App Store account upon confirming the purchase.
- Automatic Renewal: The subscription will automatically renew at the end of each period (monthly or annual) unless you disable automatic renewal in your device settings at least 24 hours before the end of the current billing cycle.
- Cancellation: You must manage and cancel your subscription directly from your Apple or Google account settings. We do not have access to your banking information and cannot cancel the subscription for you.
5. Waiver of Right of Withdrawal
In accordance with Article 103.m) of Royal Legislative Decree 1/2007, of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users:
By subscribing and accessing the digital content (analysis, routine, scanner) immediately, you expressly consent to the service beginning at that time and acknowledge that, consequently, YOU WAIVE YOUR 14-DAY RIGHT OF WITHDRAWAL.
Therefore, no refunds will be made for periods already started or unused once the service has begun to be provided.
6. Intellectual Property
All rights to the Application, including AI algorithms, source code, the "MyGlowApp" trademark, texts, graphics, interfaces, and designs, are the exclusive property of COSITY TECH S.L. or its licensors. Reproduction, distribution, reverse engineering, decompilation, or modification of the Application without express authorization is prohibited.
7. Limitation of Liability
The use of recommended products is the sole responsibility of the user. To the maximum extent permitted by law, COSITY TECH S.L. shall not be liable for:
- Adverse reactions, allergies, or lack of efficacy of recommended cosmetic products (the final purchase and application decision is the user's).
- Service interruptions due to technical causes, maintenance, or failures in the App Stores.
- Indirect damages arising from the use or inability to use the Application.
Our total liability for any claim shall be limited to the amount paid by the user for use of the service in the last 12 months.
8. Applicable Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Spain. In case of dispute, and provided that the user has the status of consumer under current regulations, the parties shall submit to the jurisdiction of the courts and tribunals of the user's domicile.
